By accessing or using our website, placing an order, or purchasing any product, you agree to be bound by the following Terms & Conditions. If you do not agree, please refrain from using our website.

1. About Dérive 

DÉRIVE is a curated e-commerce platform featuring handcrafted fashion jewelry, accessories, apparel, and design objects created by independent designers from across the world.

Dérive acts as a curator and retail facilitator, not the manufacturer of the products, unless explicitly stated.

Each product is selected for its originality, craftsmanship, and artistic expression.

2. Eligibility to Use

By using this website, you confirm that:

• You are at least 18 years of age, or accessing under parental/guardian supervision.
  
• You are legally capable of entering into binding contracts under Indian law.
  

3. Product Information & Disclaimer

• We strive to display products as accurately as possible, including descriptions, images, dimensions, and materials.
  
• Due to:

1. 1. The handmade nature of products,
   2. Natural material variations,
   3. Lighting and screen display differences,

• Minor variations in colour, texture, size, finish, or detailing may occur. These are inherent characteristics of handcrafted work and shall not be considered defects.
  
• All measurements are approximate.
  
• Styling elements shown in images (props, garments, accessories) are for representation only and not included unless specified.
  

4. Pricing & Payments

• All prices are listed in INR unless stated otherwise.
  
• Prices may be inclusive or exclusive of applicable taxes (GST), as mentioned at checkout.
  
• Dérive reserves the right to:
  

1. 1. Correct pricing errors,
      
   2. Change prices without prior notice,
      
   3. Cancel orders due to incorrect pricing, stock unavailability, or system errors.
      

Orders are confirmed only after successful payment.

5. Order Acceptance & Cancellation

• Dérive reserves the right to refuse or cancel any order due to:
  

1. 1. Stock limitations,
      
   2. Inaccuracies in product or pricing information,
      
   3. Suspected fraudulent activity,
      
   4. Violation of these Terms.
      

If your order is cancelled after payment, a full refund will be initiated to the original payment method within 7-10 working days.

6. Shipping & Delivery

• We currently ship within India only.
  
• Estimated delivery timelines are 5–10 working days, depending on location, product type, and designer dispatch timelines.
  
• Delivery timelines are indicative and not guaranteed.
  
• Dérive is not liable for delays caused by:
  

1. 1. Courier partners,
      
   2. Force majeure events,
      
   3. Natural disasters,
      
   4. Regulatory or logistical disruptions.
      

Risk of loss passes to the customer upon successful delivery.

7. Returns, Refunds & Exchanges

Due to the limited-edition, handcrafted, and curated nature of our products:

• Returns or exchanges are not accepted.
  
• Exceptions are made only if:
  

1. 1. The product received is damaged, or
      
   2. An incorrect product is delivered.
      

Conditions:

• Issues must be reported within 48 hours of delivery.
  
• Clear images and unboxing proof may be required.
  
• Products must be unused, unworn, and in original packaging.
  

Dérive reserves the right to:

• Approve or reject return/refund requests,
  
• Offer replacement or refund at its discretion.
  

Approved refunds will be processed within 7–10 working days to the original payment method.

8. Designer Responsibility Disclaimer

• Products are created by independent designers.
  
• While DÉRIVE and quality-checks listings, we do not independently certify materials, origins, or claims made by designers.
  
• Dérive shall not be held liable for allergic reactions, misuse, or personal sensitivities to materials used.
  

9. Intellectual Property

All content on this website including text, images, logos, graphics, product descriptions, and branding is the intellectual property of DÉRIVE or its licensors.

Unauthorized use, reproduction, modification, or distribution is strictly prohibited.

10. Limitation of Liability

To the maximum extent permitted by law:

• Dérive shall not be liable for indirect, incidental, or consequential damages.
  
• Liability shall not exceed the value of the product purchased.
  

11. Force Majeure

Dérive shall not be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to acts of God, strikes, pandemics, government restrictions, or logistical breakdowns.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

All disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
